Stihl LOST the Policy Embargo

    Stihl lost their not so "clever" policy and embargo they enforced in dealership with chainsaw sales. In Europe they tried and they did put in effect a policy of requiring the clientele presence for any chainsaw sale.
    Prohibiting electronic sales of chainsaws etc.

    Some people in FRANCE initiate a court case and Stihl lost as it was expected. Policy aint above the Law. So with immediate effect all EUROPEAN & SWISS Dealerships can sell chainsaws in their internet stores.

    Once again i repeat myself to some people who claimed "conspiracies" about Stihl having Superpowers and trying to infiltrate private sales etc. They just lied.
    I personally have to thank the French people who really chased this case even though it never actually effected myself in anyway. It's good to stop the bureaucratic system from Companies. Any companies and any policies that actually mean nothing.

    I'm pleased to hear this news. That’s the french for you !.... they get out and fight.:)

    And stihl's side is, from what I’ve heard before..... a safe handover and to check the owners knows all the safety of the machine...

    I’ve always thought it was a load of tosh.. the reasons given ( health & safety, duty of care)..

    But I'm an adult :eek:

    No the policy is, we have to hand it to you...

    Speaking for myself
    From 2016 it's enforced from our Ministry that loggers would have a special ID. Thats for approved professional with lots & loads of proof and paperwork
    So my questions to Stihl were:

    1. how would any idiot store owner teach me to handle saw when he only sees wood in TV
    2. Been a professional i own saws that have my name in Stihl paperwork and also operate saws in Forests that belong to our club. So if i damage a saw and need immediate replacement i ll need to drive 300-500kilometers until i reach the friendly store? Because the saw cannot be shipped due to policy?

    anyway. I ve read mail to all dealerships in Greece refering to the French incident and now approving sales

    I still prefer to go to the "brick and mortar " stores. The Stihl/JD dealer 25 plus years same salesman and main parts guy too. Know you by name. Yes they actually know saws and OPE. Same with local hardware store.

    From my best price advetised online dealer 50 miles away, this would take a 2hr drive each way, as it’s in London and things go slow around London at rush times.

    In order to minimise the impact of this policy on your ability to shop at your convenience, we cover a large area surrounding our South-East London base with our own staff delivery drivers. This allows us to deliver the product to you, take you through its proper use and help with any questions you may have.     And I forgot to say I don’t think you can even take a pic of your qualifications and a pic of your passport etc..and send it,, to show you are capable of understanding how to use the saw..

    Edit,,, now you can see why I’m pleased... although.. I guess if you have been in and are a tree surgery company. I guess they may be a little more relaxed about the hand over policy o_O

    funny story. my aunt lives near san francisco, very close to a private collector of lots of old school military stuff. tanks, big guns, troop carriers etc...he had a french tank that was unique in that it had two drivers, one on each end. the joke was that, of course, the french would make a tank that could run away in both directions :risas3:
    no offense whatsoever to any folks from france, just funny.

    Stihl is really making it's presence felt around here. In both the town where I live and the town where I work, there are dealers within walking distance of each other.

    Shouldn't have to. This decision should cover all stihl dealers; I am no lawyer though. Do you think Stihl wants to shell out millions more in legal fees and fines to get beat in court again? The fines in the US could much higher. I suspect Stihl to change their policy globally effective pronto.

    My question, is why would a corporation NOT want their dealers to sell online?

    Stihl would lose in court. Hell, everybody has the right to sell online.

    Not a lawyer, but I did stay at a Holiday Inn last night (and my daughter married a lawyer).

    Case law settled in another country has no bearing on US law or enforcement of said US law. What the court ruled in this case is that the policy that Stihl had in place in the country of the court's jurisdiction, i.e. France, violates the laws of that country.

    For the same ruling to be applied to US Stihl dealers or Stihl USA, a suit would have to be filed in US court and adjudicated here. I wouldn't expect Stihl to change anything outside of France and EU countries that share case law rulings unless a suit is filed in other countries and ruled on as in France/EU.

    T&Cs - Terms & Conditions - are business agreement between entities that dictate conduct, i.e. sales, pricing, distribution, volume, advertising, supply chain, etc, etc, etc. If Stihl requires that to hold their franchise or dealership, said dealer has to abide by their T&Cs or they get pulled, then as long as the contract is binding and not in violation of case law, you end up where we are.

    Everybody (individuals) has the right to sell online. Dealers must abide by the T&Cs in the their contracts with the parent company. This isn't a freedom issue. It's a legalistic contract issue.
