Check the oil pump assembly. Hard to track down a replacement diaphragm or pump.
I don't charge a down payment when I receive an item. But I'm not returning the item until I'm paid. I'd say you own the tools until he coughs up the changeI need some guidance here gents.
I was “given” a Stihl Kombi head and a grenade’d 576 by a buddy. Both had been abandoned on his property by the owner, who we will call Jay, for the better part of a year. Well, aforementioned items were abandoned because Jay owed a good chunk of change to the property owner. Property owner hands them to me and tells me do with them as I wish. Fast forward 2 weeks and Jay makes a payment on his debt, so property owner tells me to give Jay back the blown up tools. I give them back to Jay and he asks me if I can fix them. Of course I can fix them! He tells me to go ahead and fix them.
Kombi was a PITA, 576 is grossly destroyed p/c and I haven’t split it yet to check the crank for scoring from all the metal debris. So now I am $120 into the Kombi and it runs like a top, no major $$$ in the 576 yet. All of a sudden Jay can’t pay me. “Oh I forgot to hit the bank”, “Oh I got screwed out of this job”, “Oh I had to get one of my trucks fixed”. Jay has a very, very bad reputation for not paying bills/employees/debts. I’m not one for patience and I Dislike/don’t have time for bullchit drama like this. But, I have possession of 2 of his tools and have time and $ into each.
Suggested course of action?
I am inclined to tell him put up $$$ or shut up, but I’m not sure of legal ramnifications since I am not a business.

So who pays for your labor? And who pays for the labor to remove those parts?Just stating from a legal point of view, you cannot keep someone's property as collateral for payment. If the guy comes in and pitches a *b-word, legally he gets them back. But, as mentioned, you can take any parts you installed back off, ad they are yours until he pays for them. I know it sucks, but just mentioning it.
You could always hide the 576 saw and tell him it is out being fixed. As soon as you get it back, you'll give him a call. Lol
String him along and play the game with him. Until you get payment in full. Lol
Every small engine shop ive ever seen (in MI) does this? Maybe the difference is that they advertise that policy. The (crappy) stihl dealer near me has a big sign to the effect that payment must be made in full in 30 days or the equipment will be sold to recoup costs.you cannot keep someone's property as collateral for payment.
I totally get what you're saying. The law needs to be there to stave off over-charging for labor. I guess it's just sort-of a man law around hereI agree with you Kevin. It sucks, but you would lose out on the labor.

The tow company would have to file a claim in small claims court to get payment for service. People used to go and "steal" their car back. You can't charge them for stealing a car which they own.
