At least here in the states if you list as "for parts not working" but say in the description that it runs, the buyer can return if it doesn't run despite the description category.

If I was judge and jury the OP is in the right, just pointing out things he and others might do differently in the future to protect themselves.

I tell you what guys....
If what you are selling has ANY broken, cracked, worn, scratched, smelly, dirty, repainted, repaired or missing parts, on any level, and you fail to list the info, then the item is not properly described and the buyer is within the systems rules to ask for a refund.
I buy from ebay all the time and it's really annoying having to send so many private messages to ask simple questions that should have been answered in the item description.
When ebay investigates a claim they do check to see how much effort was put into item description.
I've described things before and the potential buyer would ask me the same thing I described.

I have sold a few saws on Aussie eBay, and this might sound stupid fella's but did this the other day (and have done before).

On an old Mac parts saw.
Buyer contacted me, asking for specific. Pictures of certain parts of a saw, was polite and apon receiving them thanked me and said he was hopeful of being lucky and winning the auction. I made a snap character judgement & just ended the auction early with the eBay feature to sell to the highest bidder.

Buyer couldn't believe it, but I made my money and it's going to a good home. Never had any hassle from any of the other eBay buyers have done this before either.

Sure it's less money, but it my money for certain.

I see no mention of a clutch or sprocket or even that the saw is complete, no pictures to indicate a clutch or sprocket is under the cover, auction listed as for parts. What you see or what is written in the description is what you get.

You'll be fine, just an inconvenience.

A bit extreme.... I prefer a lot of pictures and video if possible. Let the pictures speak for themselves. Avoid over-starting condition in the description. The real problem is eBay doesn't cater to small-time sellers. It all about the "power-sellers" and volume, they can afford to take the hits... here and there.

Thanks for all the opinions chaps, you've put my mind at ease a little for now however I guess only time will tell, there's no way on eBay for me to decline the return request so apparently I have to wait til the 15th when it will be automatically escalated!

Australia is an island too. :p

Also remember fella's, ebays terms and conditions are slightly different depending on country,

Jb - pretty sure I can help you out with a clutch and sprocket if you need?

Thanks very much for the offer, if I end up getting shafted and getting the saw back (if I even get MY saw back) then I'll be in touch to take you up on your offer!

It's for reasons like this that I love this forum, it restores my faith in humanity!

My advice, for what its worth, don't elaborate or try to explain anything to the ebay rep. Stick to your guns, stand by what you wrote in the description and the fact that it was listed as parts and by EBay's definition of part its allowed to have missing components. It would be the buyers fault for purchasing an item listed as parts expecting a fully functional chainsaw and his dispute invalid. Less is more at this point.

I have an update gents, I managed to source a used clutch on this side of the pond and had it sent out to the chap on the agreement that he cancelled the refund Request first.

Yes I probably could have won the case, but I couldn't be bothered with the hassle of it and to be honest I need the money for Christmas, so a £40 clutch was a cost I was willing to pay to shut the case down

I'd expect a 5 star rating from that. To me, you went above and beyond. I'd crush his feedback as a buyer, flippin idiot.

It is good that it didn't escalate, as you would have lost.
Right or wrong, it doesn't matter to E-Bay.
I had a guy send back a defective carb for a refund.
He send back an old, nasty, used carb. He got a free carb, and his money back, and I had to pay for all of the shipping!!
I also had one moron that cut his new MS290 fuel line in half when he sliced open his mailer. He said that it was "defective"..... Got his money back too.

Things used to different when many of us knew the sellers or buyers E-Bay handle .You knew who you could trust and who not to . From a buyers perspective it's pretty much a crap shoot any more, roll of the dice what to expect .So called new stuff might fetch a higher price that what a dealer sells it for then you have shipping on top of that .

You'd better know the prices of stuff before you leap on it .For example I ordered a bunch of sporting goods for my grand children from E-Bay .I had already priced it through Amazon.Found it cheaper and it was direct shipped from the ware house, origin Amazon. How about them apples.
