UPS damage claim

Can anyone give me a shred of hope that UPS makes this right? I'll try to keep this brief. Bought an early all original 046 off eBay last week. Seller was Great Lakes pawn. He shipped same day. Woo hoo! Saw arrives on Monday in a 4' box with the bar still attached! Wonder what that cost? Rear handle took a hard lick and is broken. Called the seller and he filed a damage claim while I was on the phone with him. Took the saw out of the box and sent him a bunch of pictures for the claim. UPS wants to inspect the box. No problem, box is in the carport. Driver comes by while I'm at work Tuesday and doesn't see it. Second attempt on Wednesday.. box is in plain sight but there's a note on the door ..... Box needs to be taped up. I just folded the end together. Geeezzzz no tape on the truck? Ok I tape up the box and it's still on the front porch this morning (Saturday). I did speak to a rep on the phone and did a "verbal inspection " with her. Once they eventually pick up and inspect the box they said 3-5 days to approve or deny. UPS won't release any info to me regarding if it was insured or if the local UPS store packed it etc.. Has anyone had success with a claim or ..... Am I screwed?

Yeah, that's what I'm afraid of. On the bright side it looks to be a well maintained survivor. I'll post a few pics of the good stuff

If the seller organised the post/shipping (that is free shipping or they charged you $xx.xx) Ie you did not send the courier. Then surely eBay or Paypal will protect your claim. But I guess ups will have to evaluate the claim, their fault or sellers packing.

That’s how it is in the UK, although it may just be different in your area.

Anyhow most peeps take the bar off, but then it has been known to make a hole and slip out and lost.

Yes I paid shipping but UPS said he was the one who actually put money on the counter. So I have to take a back seat. I'm sure this will work out one way or another. Just need to patient. anyway here's some of the good ... Big thirsty carb ;-)

If UPS did not pack it they will not cover damage EVEN if you buy insurance. That is their policy.

Is that like the ppi thing that was missold,,,(insurance in case you can’t pay, but you just can’t make a claim)
The reality is simple they throw your parcels around and drop them, and say you should have packed it so it bounces.

To break a handle like this one in question, how many guys have dropped saws from trees or even off the back of a pickup. Did they break.?
Let’s hear what has happened and the results of the saws.

They won’t approve the claim, I can see the seller modified the original box to make it longer by leaving the flaps extended. That invalidated the box manufacturers crush test rating. Ups will use any excuse not to pay, even if it had nothing to do with the damage. They also require 2” of padding on all sides of the item.

I think it is. My neighbor sent a brand new porch swing in its original unopened box from the manufacturer by UPS, it had styrofoam and heavy cardboard packing. The item cost him 150.00 and they charged him 30 dollars to insure it, but they did not tell him that if they did not pack the item the insurance was invalid. It was destroyed and my friend rolled over butt in the air and took one hard and deep by UPS. I would have sued, I don't like being punked, but this guy is a metrosexual cubicle dweller who has his stylist thin his hair with shears once a month and a haircut every two weeks. He spends a lot of time in front of a mirror. He has 6,000 dollars in chainsaws, log splitter, and a trailer, but has wood delivered and stacked at his house every winter. He is the king of posers.

I'll keep that in mind. I'm already not a fan of UPS. I'm about a mile and a half from there hub and last on the route.

UPS buried the seller in forms and hoops to jump through. Hate that but......... The Seller is a stand up guy and IMHO not the typical "ebayer". Refunded me enough to replace the tank with an oem unit. As opposed to fighting a losing battle with corporate America. All is I can say is wow. Like I said his communication was way above and beyond. Sh*t like this doesn't happen often.... At least to me
