eBay rip off help!

Okay chaps I'm looking for a bit of advice on where I stand with an item I sold.

I sold an old Stihl 084 that had been sat for a number of years, and so I listed it as spares or repair even though I did in fact get it running, and stated that it was being sold as spares or repair with no gaurantee whatsoever and would need thoroughly going over and servicing.

The seller has since opened a case for a full refund saying the item is not as described, and he is saying that it is missing the full clutch ad sprocket assembly! I suspect that they bought The saw and have stolen these items for one of their own saws and now want to return the rest for a full refund!

Now I hasten to admit that I never bloody checked under the sprocket cover, the saw came as part of a massive job lot of saws that I really Haven't had time to do anything with and so was listed exactly as it came to me.

Ebay's own description of Spares Or Repair states that the item does not work and may be missing essential components.

How do you think I'll fare against eBay's buyer protection system? Surely I can't get shafted here when the item was clearly listed as spares or repair?

Seems pretty clear. You sold it as parts or repair and the policy for parts or repair is clear. MAKE EBAY'S WRITTEN POLICY CLEAR to the rep handling the case.

I too have been a victim, though I did not sell it under "parts or repair". Take a peak under the thread I started "Some people absolutely Suck" and especially the post by Definitive Dave. Nothings guaranteed like it should be. Good luck to you, hope you fare better than I did. Theres something about those 084's......like there NLA parts are hard or expensive to find, or to use the most powerful saw in the arsenal after a hurricane and return it used as hell and damaged....

Did the saw have a clutch/sprocket when it shipped? If so, then likely the buyer is trying to scam you. I always reply to the buyer first THRU eBay ("paper trail") and try and work it out.

Then move to eBay resolution center. You'll likely be fine if you documented how the saw left your hands.

I have noticed a lot of the saws being sold on eBay now have pictures taken with the saw together and with all of the covers removed. I believe this is a deterrent to the parts harvesters. @trooney his saw had pictures showing it came back with a different starter handle than it left with. That is clear evidence that it had been tampered with. Hopefully this works out for you, but I would post more pictures in the future.

Im really sorry to hear this Joe...I watched your 084 on ebay myself while it was sold. If you didnt have sight of the clutch yourself ??? that might be a tricky one to be sure of the condition when sold. The interpretation of what constitutes "spares or repairs" and what parts can be missing from the saw to make it "not as described " ...Could.. be a minefield !
I suggest that if it seems to you that its turning into a hiding to nothing then you agree to take back the saw with the hope that you get "YOUR" saw back (there not that common so its likely) and remember it is a "very" saleable item if you want to get it sold on again. I think we have to take masses of pictures when we sell these saws and trust the pictures cut out as much of the debate as to what we are selling. I find the ebay situation more and more stressful with second hand saws now and have more or less stopped listing myself.

I tell you what guys....
If what you are selling has ANY broken, cracked, worn, scratched, smelly, dirty, repainted, repaired or missing parts, on any level, and you fail to list the info, then the item is not properly described and the buyer is within the systems rules to ask for a refund.
I buy from ebay all the time and it's really annoying having to send so many private messages to ask simple questions that should have been answered in the item description.
When ebay investigates a claim they do check to see how much effort was put into item description.

I'm sorry about your trouble but I won't sugar coat it .First of all why would anybody sell a high value saw like an 084 on E-bay,and why would anybody buy one sight unseen?

When I buy a saw from e-bay I assume something is wrong with it and seldom have I been wrong .It may be minor or it may be a lot of work so I bid accordingly as if I were buying parts .

I don't open the bid,raise the bid just watch .If it stays below my max bid I throw in a snipe with 10 seconds left for bidding .If somebody has a proxy they can have it .One thing about it ,they made lots and lots of saws .They sell them every day .

How about a link to the original auction?
Your original description and pictures will be what Ebay goes by in deciding the case.

From your first post it doesn't sound like you are sure there was a clutch and sprocket assembly there to start with, is that true?

Just to clarify, the saw was indeed sold as spares or repair and this is eBay's own description of a Spares or repairs item:

"An item that does not function as intended or is not fully operational. This included items that are defective in ways that render them difficult to use, items that require service or repair, or items missing essential components."

And it's not that I don't think the clutch wasn't there, it's just not something that I'm 100% I checked as I sorted through about 30 saws that day!

I've spoken to eBay directly and they've said I have to wait til the 15th until this gets automatically escalated and then they'll look into it.

The guy is also saying that it's obvious the clutch and sprocket have been removed recently as the crank is shiny and clean where they were. This to me once again screams that he's removed them and is trying to pull a fast one

Its too bad a guy has to worry about this type of stuff, and i agree the fact that he mentions the crank is shiny basically proves he scavenged the clutch etc and is trying to get out ahead of it. Its all about covering thine backside, with lots of pics and descriptions.

Here's the link, a bit of a small description I'll admit but I was selling a bloody broken saw, I didn't think it really mattered!

And now I'm down a clutch and sprocket assembly which would cost me £80 to replace, plus all the *f-wording about of re-selling it

Well i dont see anywhere on there where you said it was complete. If only the lighting were a just a little better in that fourth pic and you could see under the clutch cover. If it was me and i was gonna spend that much on a saw advertized as parts/spares i would likely ask if it was complete, ask for a few more pics and if i didnt and it showed up missing parts id be a little bummed, but i would know it was my fault. I just hope ebay sees it that way.

I could see this going either way.
You don't say it is complete , but you mention getting it to run and great overall condition.
Also you say it needs service and going over which sounds more like a carb kit and fuel line/filter than replacing the clutch and sprocket.
I hope they find in your favor I give you a better than even chance.

Is there any chance the buyer would keep the purchase if you offered up the missing parts? I would think a serious buyer that doesn't have the missing parts would be very interested in that.

Running and functional are not the same thing. At no time does he state it's functional. He does state it IS parts and does need repair. EBay's own boilerplate states parts and repair may be incomplete. He doesn't have to establish if there was a clutch or not.
