Internet legal observation. Take it for what it is worth.....
If the buffer tube is smooth it is considered a pistol by the ATF. If it has the buffer tube designed to attach a standard stock it is considered a SBR by the ATF and considered an NFA item. When the lower reciever was transferred from the retailer to the original buyer was it listed as a rifle, pistol or other. Depending on how the lower reciever was transfered some upper recievers and buffer tubes may not be legal. It appears to have a pistol brace attached so if it was transfered as a pistol or other it should be legal. If the lower reciever was transfered as a rifle it is considered a SBR and an NFA item regardless of the buffer tube.
